Terms of Service
Last updated: 2026-10-06
The short version. Drunk Friend is a comedy app: you chat with an AI character who has had three beers too many. It's for adults (18+) who want a friend who's always a bit tipsy. It's for fun, and its advice is bad on purpose. Don't use it for anything that matters.
1. Who we are
Drunk Friend (drunkfriend.com and its app) is run by ITECH MEDIA OÜ, registry code 11874682, VAT number EE101346346, Pärnu mnt 31-67, 10119 Tallinn, Estonia ("we", "us"). Questions: hello@drunkfriend.com.
These Terms are the agreement between you and us. By buying a plan or using your account you accept them. The Privacy Policy explains what we do with your data.
2. What Drunk Friend is
- The friends are AI, not people. No human writes their replies.
- It's entertainment. The characters are tipsy and give bad advice on purpose. Nothing they say is medical, mental-health, legal, financial or any other professional advice.
- AI gets things wrong. Replies can be inaccurate, made up or offensive.
- We don't encourage drinking. "Drunk" is the joke. If you drink, do it legally and responsibly.
- In a crisis, talk to a real person. If you're in danger or thinking about hurting yourself or someone else, call your local emergency number (112 in Europe, 911 in the US) or a crisis line. Drunk Friend can't help in an emergency.
3. Age
You must be 18 or older to use Drunk Friend. If we find out an account belongs to someone under 18, we close it and delete its data.
4. Your account
Your account is created when you buy a plan, or when we invite you. You sign in with your e-mail (we send you a code), with Google or with Apple. Keep access to your e-mail safe, and tell us if you think someone else is using your account. One account per person; you can't sell or transfer it.
You can delete your account at any time in the app (Account → Delete account). Deleting it ends your plan straight away and deletes your friends and chats; it doesn't refund what's left of your plan.
5. Plan and billing
One plan. You pay every 1, 6 or 12 months. The price and what the plan includes (messages per month, friends, themes) are shown before you pay. Prices include tax where it applies.
Monthly messages. Your message allowance resets every month from the day you bought — also inside a 6- or 12-month plan. Unused messages don't carry over.
Automatic renewal. Your plan renews automatically for the same length, at the current price, until you cancel. For 6- and 12-month plans we e-mail you about 30 days before they renew.
Cancel any time in the app (Account → Billing). You keep your plan until the end of the period you paid for, and it doesn't renew.
Changing length. If you switch to a different length, it changes right away and the difference is charged or credited at once, as shown before you confirm.
Extra messages. When your monthly messages run out you can buy a one-time pack of extra messages. Pack messages don't expire and are used only after your monthly messages are gone.
Payments go through Stripe; we never see your full card number. If a renewal payment fails and Stripe can't collect it, your plan ends.
Price changes apply only from your next renewal, and we tell you by e-mail at least 30 days before, so you can cancel if you don't agree.
6. Refunds
Payments are non-refundable, except where these Terms or the law say otherwise. If you are a consumer in the EU or the UK, you can withdraw from a purchase within 14 days by e-mailing hello@drunkfriend.com, and we refund the part you haven't used.
7. Rules
Don't:
- let anyone under 18 use Drunk Friend;
- use it for anything illegal, or to create sexual content involving minors, threats, harassment of real people, or content that infringes someone else's rights;
- try to trick the characters past their safety limits;
- scrape, resell or automate it (bots, scripts), or use it to train other AI;
- attack, overload or try to get around our security or limits, or get into other people's accounts.
Every message is checked automatically by a safety filter before the AI sees it, and some messages are blocked. If you break these rules we may limit, suspend or close your account — without a refund if the breach is serious.
8. Your content
What you write (messages, friend names and descriptions) stays yours. You let us store and process it only to run Drunk Friend for you — for example to send it to the AI that writes the reply, to build your friend's memory, and to show your chats back to you. We don't sell your chats, use them for ads, or use them to train AI models.
You may use the replies your friends write for you for personal purposes.
9. Our content
The characters, artwork, names, design, software and the Drunk Friend brand belong to us or our licensors. You can use them inside Drunk Friend, as these Terms allow.
10. Changes to Drunk Friend
We keep changing things. Characters (including limited-time bonus characters), themes, AI models and features may change or go away. Bonus characters may have their own message limits and dates. If we remove a main part of your paid plan during a period you've paid for, we tell you first and you can cancel and get a refund for the rest of that period.
11. Notifications
If you turn them on, your friends can send you push notifications — like a 3am line, or a nudge when you've left a chat hanging. Turn them off any time in the app or in your phone's settings.
12. Ending things
You can stop using Drunk Friend and delete your account any time (see section 4). We can suspend or close an account that breaks these Terms (section 7). If we shut Drunk Friend down, we give you at least 30 days' notice and refund the unused part of any prepaid plan.
13. Liability
Drunk Friend is provided "as is", for entertainment. We aren't responsible for what you decide to do because of something a character said, or for losses we couldn't reasonably foresee. Our total liability to you is limited to the greater of $100 or what you paid us in the 12 months before the claim.
Nothing in these Terms takes away rights you have as a consumer under the law where you live, or limits liability that the law doesn't allow us to limit (such as for fraud, or for death or injury caused by negligence).
14. Changes to these Terms
We may update these Terms. If a change matters, we tell you by e-mail or in the app before it applies. If you don't agree, you can cancel before then. The date at the top shows the current version.
15. Law and disputes
These Terms are governed by Estonian law. If you're a consumer, you also keep the protection of the consumer law where you live. Please e-mail us first — most things can be fixed quickly. Otherwise, disputes go to the courts of Estonia (Harju County Court), or, if you're a consumer, to the courts where you live. Consumers in the EU can also turn to the Estonian Consumer Disputes Committee (ttja.ee).
16. General
If part of these Terms turns out to be invalid, the rest still applies. If we don't enforce something right away, we haven't given it up. We may transfer these Terms to a company that takes over Drunk Friend; your rights stay the same.
